Petition for AZ SBE to reverse AZ OAH decision recommending appeal denial
To Whom It May Concern:
I am writing to express my strong support for RJ's appeal case# 24C-ESA-041-SBE regarding the denial of their Empowerment Scholarship Account (ESA) funds for the purchase of Amateur Radio equipment. This denial, based on the misclassification of this equipment as "home theatre and audio equipment," is a profound misunderstanding of Amateur Radio's educational value and purpose.
Amateur Radio is not a passive entertainment system. It is a federally licensed service with a rich history of hands-on learning, technical skill development, and community engagement. The FCC defines Amateur Radio as "a radiocommunication service for the purpose of self-training, intercommunication and technical investigations carried out by amateurs, that is, duly authorized persons interested in radio technique solely with a personal aim and without pecuniary interest." 47 CFR 97.3(a)(4) https://www.ecfr.gov/current/title-47/part-97#p-97.3(a)(4)
The equipment in question is essential for accessing this educational pursuit. It enables students to:
Grasp STEM Concepts: Building and operating Amateur Radio equipment provides practical application of electronics, physics, and radio wave propagation. Develop Critical Thinking: Troubleshooting, problem-solving, and adapting to varying conditions are integral to successful Amateur Radio operation. Master Communication Skills: Effective communication is paramount in Amateur Radio, encompassing clear articulation, concise language, and proper radio etiquette. Serve the Community: Amateur Radio operators play a vital role in emergency communications, disaster relief, and public service events. Classifying Amateur Radio equipment as "home theatre and audio equipment" disregards its unique educational benefits and its regulated, purposeful nature. Home theatre equipment is for entertainment (watching movies, listening to music). Amateur Radio equipment is for two-way communication using designated radio frequencies. It's a licensed service with a focus on learning, experimentation, and emergency communication. This misclassification undermines the intent of the ESA program, which is to empower parents with educational choices for their children.
I urge the review board to reconsider this denial and recognize the inherent educational value of Amateur Radio. By approving this appeal, you will not only support RC's child but also affirm the importance of diverse learning pathways for all Arizona students.
Sincerely,
